ALLIANCE INITIATIVES SIGNED INTO LAW
Two bills have recently been signed into law that were initiated by the School Management Alliance. HB 5529 ( Crespo, D-Hoffman Estates) extends by three years the expiration date of the law that allows for school districts to transfer monies between dedicated funds. This provision is a necessary tool that gives school districts additional flexibility in handling local finances. Historically, the provision has never been permanent but always contains a sunset date that requires legislative action to be renewed. The bill is now Public Act 99-0713, effective Aug. 5, 2016.
SB 2823 (Koehler), in the case of a residential property constructed or renovated by students as part of a curricular program, allows a school board, by a resolution adopted by at least two-thirds of the board members, to engage the services of a licensed real estate broker to sell the property for a commission not to exceed 7%, contingent on the sale of the property within 120 days. This initiative is the result of IASB’s Resolution and Delegate Assembly process, with the proposal having been adopted by school board members in 2015. The bill is now Public Act 99-0794, effective Jan. 1, 2017.
OTHER LEGISLATION RECENTLY SIGNED INTO LAW
HB 4432 (Moffitt, R-Gilson) allows a child in any of grades 6-12 to be absent from a public school on a particular day for the purpose of sounding "Taps" at a military honors. The bill is now Public Act 99-0804, effective Jan. 1, 2017.
HB 4462 ( Mussman, D-Schaumburg) extends the opportunity for the self-administration and self-carry of asthma medication and epinephrine auto-injectors to students while being transported to and from school and adds school bus drivers to the list of who can be "trained personnel.” The bill is now Public Act 99-0711, effective Jan. 1, 2017.
HB4983 (Soto, D-Chicago) establishes the State Global Scholar Certification Program to recognize public high school graduates who have attained global competence, sufficient for meaningful use in college and a career. The bill is now Public Act 99-0780, effective Aug. 12, 2016.
HB 4996 (Welch, D-Hillside) allows a school board to appoint at least one employee to act as a liaison to facilitate the enrollment and transfer of records of students in the legal custody of the Department of Children and Family Services (DCFS) when enrolling in or changing schools. Liaisons are encouraged to build capacity and infrastructure within the school district to support students in the legal custody of DCFS. The bill is now Public Act 99-0781, effective Aug. 12, 2016.
HB 5683 (Breen, R-Lombard) allows a person to bring a civil action in the circuit court within 60 days of the decision by the Attorney General to resolve a request for review by means other than the issuance of a binding opinion. The bill is now Public Act 99-0714, effective Aug. 5, 2016.
HB 6086 ( Kifowit, D-Aurora) requires the Department of Human Services to consider the length of time spent on the prioritization of Urgency of Need waiting list when selecting individuals on the list for services, and requires the Illinois State Board of Education (ISBE) to inform patients and guardians about this consideration. The bill is now Public Act 99-0716, effective Jan. 1, 2017.
HB 6131 (Hurley, D-Chicago) provides that driver education courses shall include instruction concerning law enforcement procedures for traffic stops, including a demonstration of the proper actions to be taken during a traffic stop and appropriate interactions with law enforcement. The bill is now Public Act 99-0720, effective Jan. 1, 2017.
HB 6136 (Wallace, D-Rockford) creates the Advisory Council on At-Risk Students within ISBE. The bill is now Public Act 99-0721, effective Aug. 5, 2016.
HB 6252 (Willis, D-Addison) allows an elementary school district to withdraw from its special education joint agreement program under certain circumstances. The bill is now Public Act 99-0729, effective Aug. 5, 2016.
SB 2227 (Holmes, D-Aurora) requires the Department of Commerce and Economic Opportunity to submit a bi-yearly review and report on mandates (beginning in 2019) detailing the nature and scope of each existing state mandate enacted the previous two years. The bill is now Public Act 99-0789, effective Aug. 12, 2016.
SB 2469 ( Lightford, D-Maywood) increases the debt limit, under certain conditions, for Bureau Valley CUSD 340, Paxton-Buckley- Loda CUSD 10, and Hillsboro CUSD 3. The bill is now Public Act 99-0735, effective Aug. 5, 2016.
SB 2612 (Koehler, D-Peoria) extends by five years when the assessment of wind energy devices applies. The bill is now Public Act 99-0825, effective Aug. 16, 2016.
SB 2835 ( Manar, D-Bunker Hill) requires a vehicle to stop before meeting or overtaking, from either direction, a stopped school bus on a highway, roadway, private road, parking lot, school property, or at any other location. The bill is now Public Act 99-0740, effective Jan. 1, 2017.
SB 2840 (Silverstein, D-Chicago) requires a regional superintendent of schools to waive required fees for GED testing for an applicant who qualifies as a homeless person, child, or youth as defined in the Education for Homeless Children Act, has not attained 25 years of age as of the date of the scheduled test, and can verify his or her status as a homeless person, child, or youth. The bill is now Public Act 99-0742, effective Jan. 1, 2017.
SB 2896 ( Althoff, R-Crystal Lake) provides annual notice to Illinois Municipal Retirement Fund (IMRF) annuitants that they must report employment with an IMRF employer. Reimbursement to the fund is shared when a violation occurs, and for employers only when they have knowingly failed to notify IMRF to suspend the annuity. The reimbursement provisions do not apply if the annuitant returned to work with the employer for less than 12 months. The bill is now Public Act 99-0745, effective Aug. 5, 2016.
SB 2972 (Harmon) amends the IMRF Article of the Illinois Pension Code to allow a participant who is terminating service to elect a separation benefit rather than a retirement annuity if his or her annuity would be less than $100 (now $30) per month. The bill is now Public Act 99-0747, effective Jan. 1, 2017.
HB 2975 (Cunningham, D-Chicago) creates an agriculture education teacher grant program to fund personal services costs for agriculture education teachers in school districts, subject to appropriation. The bill is now Public Act 99-0826, effective Jan. 1, 2017.
